Terms of Service

Gifted helps families run group gifting for kids' birthday parties. These terms are an agreement between you and Alistair Lamond, a sole trader trading as Gifted (ABN 13 612 003 953)(“Gifted”, “we”, “us”). By using Gifted — as a party host or as a guest — you agree to these terms. If you don't agree, please don't use the service. How we handle your personal information is covered separately in our Privacy Policy.

Who can use Gifted

You must be at least 18 years old to create an account, host a party, or contribute money. Gifted is intended for use in Australia. Children don't use Gifted directly — a party is set up and run by an adult host, and guests are adults contributing on a child's behalf.

Your account

You sign in with your mobile number and a one-time code we text you. You're responsible for keeping access to that number secure and for activity that happens under your account. Let us know promptly if you think someone else has gained access to it. The details you give us — your name, party details, and anything you enter — must be accurate and your own to share.

Hosting a party

As a host, you set up the party, invite guests, and decide how contributions are used. You are responsible for the party you run and for honouring what you tell your guests their contributions are for. Gifted provides the tools to collect contributions and pay them out to you — we are not a party to the gift itself and don't guarantee any particular outcome for guests.

To receive a payout you complete identity and bank details through our payments provider, Stripe. Payouts are subject to Stripe's verification and to your acceptance of Stripe's connected-account terms, which is separate from these terms.

Contributions, fees, and payouts

Guests contribute money towards a party through Stripe, our payments provider. When you contribute, you authorise the charge shown at the time. Contributions are collected on the host's behalf and paid out to the host once the party is ready for payout.

Gifted's only charge is an optional platform tip a host may choose to add when they request a payout — we don't take a cut of guest contributions. Stripe may apply its own processing fees. The amounts shown to you at the time of a contribution or payout are the amounts that apply.

Refunds and cancellations

If a host cancels a party, we'll aim to refund contributions to the guests who paid. Because contributions move through Stripe and out to hosts, refunds may depend on the stage a party has reached — for example, whether a payout has already been made. If something has gone wrong with a contribution or a party, contact us at hello@gifted.party and we'll work with you to sort it out.

Content you provide

Hosts may upload a party photo, and hosts can record a thank-you photo or video after the party. You keep ownership of the content you provide. By uploading it, you give us permission to store it and show it to the people it's meant for — for example, displaying a party photo to invited guests, or delivering a thank-you to contributors — so we can run the service. You're responsible for having the right to share anything you upload, including images of children, and for making sure a parent or guardian is happy for a child's image to be used.

Acceptable use

You agree not to use Gifted to:

We may suspend or remove access, or remove content, if we reasonably believe these terms are being broken or the service is being misused.

Text messages

Gifted runs on SMS — we send transactional texts such as invites, sign-in codes, receipts, payout alerts, and thank-yous to the mobile numbers hosts and guests provide. By giving a mobile number, you confirm you're entitled to receive messages at it. Standard carrier rates may apply. These are service messages needed to run a party, not marketing.

Third-party services

Gifted relies on third parties to operate — including Stripe for payments and identity verification, and an SMS provider for messaging. Your use of those services through Gifted may also be subject to their own terms. We're not responsible for third-party services themselves, but we choose our providers carefully.

Availability and changes to the service

We work to keep Gifted running reliably, but we provide the service “as is” and can't promise it will always be available or error-free. We may add, change, or remove features, and we may need to interrupt the service for maintenance.

Our responsibility to you

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that can't be excluded. Those rights always apply. Where the law allows us to limit our liability, we do — Gifted isn't liable for loss that we couldn't reasonably have foreseen, or for matters outside our reasonable control (including the acts of hosts, guests, or third-party providers). To the extent permitted by law, where we are liable, our liability is limited to re-supplying the service or the amount of any Gifted fee you paid for the party in question.

Ending your use of Gifted

You can stop using Gifted at any time, and you can ask us to close your account as described in our Privacy Policy. We may suspend or end access if these terms are broken or if we need to for legal or security reasons. If you have an active party or a payout in progress, we'll ask you to wrap that up first.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the “last updated” date above, and for significant changes we'll let you know in the app. Continuing to use Gifted after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and Gifted submit to the courts of that state — without limiting any rights you have under laws that apply to you.
